How Can Foreigners Apply for Permanent Residency in China?

China PR Application

As a foreigner, getting that Chinese green card (permanent residency status) sounds incredibly appealing. But let's be real - with China's massive population and cautious approach to immigration, the bar for securing permanent residency is set pretty high.

At Hongda, we're breaking down the 2025 application process based on China's official 2019 regulations. Think of this as your no-nonsense roadmap to putting down roots in the Middle Kingdom.

 

Enterprise Investors

1.  Basic Requirements

Direct investment in China + stable operations for 3 consecutive years + clean tax record;

2. Key Interpretations:

  • Direct investment means setting up shop as a WFOE (Wholly Foreign-Owned Enterprise), EJV (Equity Joint Venture), or CJV (Cooperative Joint Venture). Sorry folks - stock investments, property purchases, or fund trading don't count here.
  • Stable operations require your business to survive at least 3 years without major penalties from customs, tax, or industry regulators. Keep your company off the blacklist, and make sure your registered capital is fully paid up.
  • Clean tax records are non-negotiable. Your business must pay VAT, corporate taxes, and you personally need to settle income taxes on dividends. No creative accounting allowed.

3. Application Documents:

  • Standard paperwork (passport, health certificate, non-criminal record certificate)
  • Business license copy
  • Annual company report
  • Foreign-invested project confirmation letter
  • Capital verification report
  • For encouraged industries: National Encouraged FDI Project Certificate
  • Personal tax payment records

 

Professionals & Executives

1.  Basic Requirements

VP/Deputy Director/Professor-level role + 4 years continuous employment + 3+ years physical presence in China + clean tax history

2. Key Interpretations:

  • Your title matters - think C-suite, factory directors, full professors, or equivalent. Department managers or assistant professors are not qualified to apply. National recognition for "equivalent positions" counts too.
  • That 4-year employment clock only runs with one employer (or affiliated companies). If you switched job, please bring every contract and termination letter to prove continuous legal work status.
  • Physical presence means actually living in China for 3+ years within that 4-year period. Extended trips abroad (over 30 days) require documented excuses.
  • Tax compliance is crucial - four years of complete personal tax records showing every yuan of tax paid.

3. Application Documents:

  • Standard paperwork (passport, health certificate, non-criminal record certificate)
  • Employment verification
  • Work permit copies
  • Company registration documents
  • Annual business report
  • Project leadership evidence
  • Personal tax certificates

 

Regarding Investment Amount and Income Standards

For the above mentioned two categories, many people ask exactly how much investment is required for approval, or how much tax payment will qualify. According to regulations, an income at four times the social average wage is considered high-income for managerial positions. This translates to requiring a monthly income around RMB 40,000, with personal income tax approximately RMB 4,000 per month. It’s important to note this is only the baseline threshold – actual approval also requires meeting continuity and stability requirements.

 

Exceptional Contributors

1.  Basic Requirements

"Significant contributions to China" or "nationally-needed expertise"

2. Key Interpretations: 

While the definition of the term ‘significant contributions’ is not clearly stated, this typically covers

  • Receiving Chinese national-level commendations (such as the People's Republic of China International Science and Technology Cooperation Award, Chinese Government Friendship Award, etc.), or serving in a core role and achieving breakthrough results in major international scientific research projects (such as the Human Genome Project, International Thermonuclear Experimental Reactor Project);
  • Generating nationwide positive impact in public welfare fields like promoting peace, poverty alleviation, disaster prevention/reduction, and public health crisis response (e.g., COVID-19 pandemic control);
  • Involving talent scarcity in nationally critical fields such as integrated circuits, artificial intelligence, and biological breeding;

3. Application Documents:

  • Standard paperwork (passport, health certificate, non-criminal record certificate)
  • Recommendation letter from relevant ministry (e.g., MOST for tech talent)
  • Awards or achievement documentation

 

Family Reunification

Split into four scenarios:

1. Spouses/Children of Residents:

  • Requirements: Spouse/child under 18 of existing green card holder
  • Documents: Marriage/birth certificates + resident's permanent ID

2. Spousal Reunion:

  • Requirements: Married 5+ years to Chinese citizen/resident and living in China 5+ years (9+ months/year) with stable income & housing
  • Documents: Marriage certificate + spouse's ID + housing proof + financial evidence

3. Minor Children Reunion

  • Requirements: Unmarried children under 18 joining parents
  • Documents: Birth certificate + parents' IDs (Chinese ID or foreigner's permanent ID) + custody papers if divorced

4. Elderly Dependent Relatives

  • Requirements: Seniors (60+) with no overseas family joining relatives in China, living locally 5+ years (9+ months/year) with financial support & housing
  • Documents: Overseas family absence proof + kinship verification + relative's ID + housing/income proof


Upon obtaining a permanent residency in China, you will be entitled to the following rights:

  1. Unlimited duration of stay in China. You may enter and exit China using a valid passport and the Foreign Permanent Resident ID Card without requiring a visa.
  2. Employment in China without needing to apply for a Foreigner's Work Permit.
  3. Conducting foreign direct investment within China using legally obtained RMB funds.
  4. Enrollment of accompanying children in compulsory education. Eligible children may benefit from relevant policies.
  5. Using the Foreign Permanent Resident ID Card as a valid identification document to participate in social insurance procedures.
  6. When handling financial services (banking, insurance, securities, futures) in China, the Foreign Permanent Resident ID Card serves as proof of identity, granting equal rights, obligations, and statistical categorization as Chinese citizens.
  7. Boarding domestic flights in China using the Foreign Permanent Resident ID Card for check-in procedures; purchasing train tickets using the Foreign Permanent Resident ID Card when traveling by rail in China; completing accommodation registration at Chinese hotels using the Foreign Permanent Resident ID Card.
